Terms of Service

Note: This version is a structural draft prepared for legal review. The content reflects the planned operation of Ganaderos but requires validation by an attorney licensed in Florida and in the target user jurisdictions (Mexico, Colombia, Argentina, Brazil) before public launch. In case of conflict between this English translation and the Spanish version, the Spanish version prevails.

1. Acceptance

By creating an account, downloading the application, or using any Ganaderos service, you accept these Terms of Service (the “Terms”) and the Privacy Policy. If you do not agree, you must refrain from using the Service.

These Terms constitute a legally binding agreement between you and the provider identified in Section 2.

2. Provider identification

Ganaderos is operated by TAP Consulting Services LLC, a limited liability company organized under the laws of the State of Florida, United States, with registered office at:

For purposes of these Terms, “Ganaderos”, “we”, “us”, “our” or “the Service” refer to TAP Consulting Services LLC operating under the Ganaderos brand.

3. Description of the service

Ganaderos is a mobile application for the integrated management of livestock and agricultural operations. Functions include, but are not limited to: animal inventory, sanitary and reproductive event records, production records (milk, meat, eggs, etc.), basic financial management, event calendar, and reports.

The Service is offered as a free tier (“Free”) with limited features and advertising, and as a paid subscription tier (“Pro”) with extended features and no advertising. Plan details are published within the application and may change with reasonable notice.

4. User accounts and eligibility

4.1 Minimum age. To create an account you must be at least 18 years of age or the legal age of majority in your jurisdiction of residence, whichever is greater.

4.2 Accurate information. You agree to provide truthful, complete and updated registration information, including name, valid email address, and country of operation.

4.3 Credential security. You are responsible for keeping your password and any access tokens confidential. You must notify us immediately at hola@ganaderos.app if you suspect unauthorized access to your account.

4.4 One account per person. Sharing credentials is not permitted. For multi-user access to a single farm use the team invitation features when available.

5. Pro subscription, payments and auto-renewal

5.1 Processing. Pro subscriptions are processed exclusively through the in-app purchase systems of the Apple App Store and Google Play, technically managed via RevenueCat. Ganaderos does not process or store credit card data.

5.2 Auto-renewal. Pro subscriptions automatically renew at the end of each period (monthly or annual) unless the user cancels at least 24 hours before the end of the current period through the App Store or Google Play account settings.

5.3 Cancellation and refunds. You may cancel your subscription at any time from your Apple or Google account settings. Refunds are subject to the policies of Apple App Store and Google Play; Ganaderos does not process refunds directly.

5.4 Price changes. Price changes will be notified at least 30 days in advance through the application or by email. If you do not accept the new price, you may cancel the subscription before the next renewal.

5.5 Trial period. Where free trial periods are offered, they will automatically convert to paid subscriptions at the end of the period if not cancelled beforehand.

6. Acceptable use

You agree not to:

  • Use the Service for illegal or fraudulent activities, or activities that violate the rights of third parties
  • Upload false information that could mislead sanitary authorities, buyers, or third parties
  • Reverse engineer, decompile, or attempt to extract the source code of the application
  • Access the Service through automated means (scraping, bots) without express authorization
  • Deliberately overload the infrastructure (denial of service)
  • Interfere with application security or attempt to access other users’ accounts
  • Resell, sublicense, or redistribute the Service without written authorization
  • Use the Service to compete directly with Ganaderos

We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice.

7. User content and data ownership

7.1 Ownership. You retain all rights to the data you enter into the Service (animal information, production records, financial data, photographs, etc.). These are and will always be your data.

7.2 Limited license to Ganaderos. So we can provide the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, process, display and back up your data solely for the purpose of operating the application.

7.3 Export. At any time you may export your data in open formats (CSV, PDF) from the application. If you delete your account, we will delete your data as described in the Privacy Policy.

7.4 Backup. We perform periodic database backups as part of normal Service operation. These backups may persist for up to 90 days after account deletion before being permanently purged, aligned with Section 7 of the Privacy Policy.

8. Ganaderos intellectual property

The “Ganaderos” mark, logo, application design, source code, editorial text, and any other creative material produced by us are the property of TAP Consulting Services LLC and are protected by applicable intellectual property laws. These Terms do not grant you a license over these elements beyond normal use of the application.

9. Service availability

9.1 Best effort. We make reasonable efforts to keep the Service available but do not guarantee uninterrupted availability. The Service is provided “as is” and “as available”.

9.2 Maintenance. We may temporarily suspend the Service to perform scheduled maintenance, security updates, or emergency repairs. We will notify scheduled maintenance with reasonable advance notice.

9.3 Offline operation. The application is designed to function partially offline. However, certain features (synchronization, subscriptions, server-generated exports) require an internet connection.

10. Limitation of liability

To the maximum extent permitted by applicable law, Ganaderos and TAP Consulting Services LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, loss of animals, business decisions based on Service information, or any other harm arising from the use or inability to use the Service.

Our total aggregate liability for any claim relating to the Service shall not exceed the total amount you have paid us for subscriptions in the 12 months preceding the event giving rise to the claim, or one hundred (100) United States dollars, whichever is greater.

Some jurisdictions do not allow certain liability limitations, in which case the foregoing limitations shall apply to the maximum extent permitted.

11. Disclaimer of warranties

The Service is provided “AS IS” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Important: Ganaderos is a management tool. It does not replace the professional judgment of veterinarians, accountants, or compliance with local sanitary or tax regulations. Reproductive, sanitary, commercial, and regulatory decisions are the exclusive responsibility of the user.

12. Indemnification

You agree to indemnify and hold harmless TAP Consulting Services LLC, its officers, employees, and agents, from any claim, damage, obligation, loss, reasonable defense expense, or attorneys’ fees, arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of third-party rights, including intellectual property or privacy rights.

13. Suspension and termination

13.1 By you. You may stop using the Service at any time by deleting your account from the application settings.

13.2 By us. We may suspend or terminate your account if: (a) you violate these Terms; (b) you use the Service fraudulently; (c) by legal requirement; or (d) if we cease operating the Service in your jurisdiction, with reasonable notice.

13.3 Effect of termination. Upon termination of your account, you will lose access to the Service. Your data will be deleted as described in the Privacy Policy. Provisions of these Terms which by their nature must survive (intellectual property, limitation of liability, indemnification, applicable law) shall survive termination.

14. Privacy

The processing of personal data is governed by our Privacy Policy, which is an integral part of these Terms.

15. Modifications to the terms

We may modify these Terms to reflect changes to the Service or legal requirements. Material modifications will be notified within the application at least 15 days before their effective date. If you continue using the Service after the effective date, you will be deemed to have accepted the modified Terms. If you do not agree, you must stop using the Service before that date.

For Pro subscribers, material changes affecting your rights during a paid period will be notified with the option to cancel and obtain a prorated refund through the corresponding payment channel, subject to Apple App Store and Google Play policies.

16. Governing law and jurisdiction

These Terms are governed by the laws of the State of Florida, United States of America, without regard to its conflict of laws principles. Any controversy shall be resolved before the competent courts of Miami-Dade County, Florida, unless mandatory consumer protection rules applicable to the customer indicate another forum.

For users in the European Union, Mexico, Colombia, Argentina, Brazil, or any jurisdiction whose consumer protection legislation establishes non-waivable forum or applicable law, such rules shall prevail over the provisions of this Section to the extent applicable.

17. General provisions

17.1 Entire agreement. These Terms, together with the Privacy Policy, constitute the complete agreement between you and Ganaderos regarding the Service.

17.2 Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force.

17.3 Waiver. The non-exercise of a right does not constitute a waiver of it.

17.4 Assignment. You may not assign your rights under these Terms without our written consent. We may assign these Terms to a successor or affiliated entity with reasonable notice.

17.5 Language. In case of discrepancy between the Spanish version and other language versions of these Terms, the Spanish version shall prevail, except where applicable law provides otherwise.
